OS RISCOS DA FADIGA NA OPERAÇÃO AÉREA E AS MUDANÇAS TRAZIDAS PELA NOVA LEI DO AERONAUTA E RBAC 117 THE RISKS OF FATIGUE IN AIRLINE OPERATIONS AND THE CHANGES BROUGHT BY THE NEW AERONAUT LAW AND RBAC 117

Resumo

O presente artigo apresenta um estudo sobre a nova Lei do Aeronauta (13.475/17) e a RBAC 117, trazendo um comparativo da antiga com a nova regulamentação, para elucidar os avanços na lei, principalmente no que se refere ao gerenciamento dos riscos de fadiga nos aeronautas. O artigo ainda apresenta um breve estudo sobre a fadiga nos aeronautas, suas principais causas e efeitos na operação aérea. Como resultado, essa pesquisa traz um quadro comparativo entre a antiga e a nova regulamentação, além de expor detalhes da utilização do RBAC 117, e foi concluído que a nova legislação traz um foco maior para as questões de fadiga através de limites de madrugadas, jornadas e tempo de voo, visando um aumento da segurança operacional. Os dados para tal pesquisa são adquiridos através de pesquisa bibliográfica e documental, com a intenção de trazer o histórico de evolução dessa regulamentação, as principais mudanças e seus efeitos.

ABSTRACT

This article presents a study about the new law 13.745/17 and RBAC 117, concerning aeronautical crew regulations in Brazil, bringing a comparative between the old and new regulations, showing the advances in the law, mostly regarding crew fatigue risk management. This article also presents a short study about crew fatigue, its causes and effects. The result of this article is a comparative board between the old and new legislation, and also the details about RBAC 117 limitations. The conclusion is that te new regulantion brings more focus to fatigue through flight time, red-eye flight limitantions, in order to improve operational safety. The data used in this article is from bibliografic and documental research, intending to present the historical evolution of this regulation and the main changes and effects.
